Silicon Valley erfindet, China kopiert, Europa reguliert. Für viele Mittelständler klingt das nach hämischer Resignation – irgendwo zwischen Bewunderung für die US-Innovationskraft, Sorge vor China und Genervtsein über Brüssel. Doch dieses Bild greift zu kurz. Europa baut vielleicht keine eigenen Hyperscaler oder Consumer-Smartphones, aber Europa besetzt das digitale Fundament: die Regeln, nach denen KI-Systeme in der Praxis eingesetzt werden dürfen.

Damit verschiebt sich die Frage für mittelständische Unternehmen im B2B-Handel und in der Produktion: Nicht mehr „Welche KI ist am cleversten?“, sondern „Welche KI kann ich rechtssicher, auditierbar und in meine Prozesse integriert betreiben?“.

Europa als Filter für vertrauenswürdige KI

Mit dem EU AI Act zieht Europa eine klare Grenze: Wer im EU-Binnenmarkt mit KI Geld verdienen will, muss sich an europäische Spielregeln halten – unabhängig davon, ob die Rechenzentren in Kalifornien, Dublin oder Singapur stehen. Entscheidend ist, wo die KI wirkt und wessen Daten verarbeitet werden.

Die Verordnung teilt KI-Anwendungen in Risikoklassen ein und legt für Hochrisiko-Systeme strenge Anforderungen fest – etwa bei Personalentscheidungen, Kreditvergabe, Qualitätsprüfung sicherheitsrelevanter Komponenten oder der Steuerung kritischer Infrastruktur. Vollautomatisierte „Blackbox“-Entscheidungen ohne menschliche Kontrollmöglichkeit sind damit passé. Gefordert werden dokumentierte Datenherkunft, nachvollziehbare Modelle und eine echte Human-in-the-Loop-Instanz.

Für den Mittelstand bedeutet das: Europa ist weniger „Herrscher über den Code“ als vielmehr Filter. Wer durch diesen Filter kommt, signalisiert: Diese Lösung ist nicht nur smart, sondern auch verantwortbar.

Was der AI Act für den Mittelstand wirklich verändert

Viele mittelständische Unternehmen in DACH stehen noch am Anfang der KI-Nutzung – oft mit Pilotprojekten, einzelnen Use Cases oder experimentellen Integrationen in bestehende Systeme. Mit dem AI Act kommen drei neue Realitäten hinzu:

  • Beweislastumkehr: Wenn eine KI diskriminiert, fehlerhafte Entscheidungen trifft oder Schaden verursacht, muss das Unternehmen nachweisen, dass das System korrekt entwickelt und betrieben wurde.
  • Dokumentations- und Governance-Pflichten: Datenherkunft, Trainingslogik, Monitoring und menschliche Eingriffsmöglichkeiten müssen konzeptionell und technisch verankert sein – nicht nur „für die Schublade“, sondern prüfbar.
  • Compliance als Markteintrittskarte: Für viele Lieferketten – insbesondere Richtung OEMs und Großkunden – wird AI-Compliance Teil der Lieferantenanforderungen.

Gerade im B2B-Handel und in der Produktion treffen diese Regeln auf sensible Einsatzfelder: Preis- und Rabattlogik, Lieferantenbewertung, automatisierte Disposition, Qualitätsprüfung, Wartungsentscheidungen, HR-Auswahlprozesse. Was heute als „praktisches KI-Feature“ beginnt, kann schnell in die Kategorie Hochrisiko rutschen – mit entsprechenden Pflichten.

Warum ERP das Rückgrat der KI-Compliance wird

In vielen mittelständischen Unternehmen ist das ERP-System bereits heute der zentrale Ort für Stamm- und Bewegungsdaten: Artikel, Stücklisten, Kunden, Lieferanten, Preise, Aufträge, Bestände, Produktionsdaten. Silicon Valley invents, China copies, Europe regulates. To many mid-market leaders this sounds like resigned sarcasm – somewhere between admiration for US innovation, concern about China and frustration with Brussels. But that picture falls short. Europe may not build its own hyperscalers or consumer smartphones, but Europe occupies the digital foundation: the rules by which AI systems may be used in practice.

This shifts the question for mid-market companies in B2B trade and manufacturing: no longer “Which AI is the cleverest?”, but “Which AI can I operate in a legally compliant, auditable way, integrated into my processes?”.

Europe as a filter for trustworthy AI

With the EU AI Act, Europe draws a clear line: anyone who wants to earn money with AI in the EU single market must follow European rules – regardless of whether the data centres are in California, Dublin or Singapore. What matters is where the AI takes effect and whose data is processed.

The regulation classifies AI applications into risk classes and sets strict requirements for high-risk systems – for example in personnel decisions, lending, quality inspection of safety-relevant components or control of critical infrastructure. Fully automated “black box” decisions without human oversight are therefore a thing of the past. What is required: documented data provenance, traceable models and a real human-in-the-loop.

For the mid-market this means: Europe is less “ruler over the code” than a filter. Whoever passes through this filter signals that a solution is not only smart, but also accountable.

What the AI Act really changes for the mid-market

Many mid-market companies in DACH are still at the beginning of AI adoption – often with pilots, individual use cases or experimental integrations into existing systems. The AI Act adds three new realities:

  • Reversal of the burden of proof: if an AI discriminates, makes faulty decisions or causes harm, the company must prove that the system was developed and operated correctly.
  • Documentation and governance obligations: data provenance, training logic, monitoring and human intervention must be anchored conceptually and technically – not “for the drawer”, but verifiably.
  • Compliance as a market entry ticket: for many supply chains – especially towards OEMs and large customers – AI compliance becomes part of supplier requirements.

Especially in B2B trade and manufacturing, these rules meet sensitive fields: pricing and discount logic, supplier evaluation, automated scheduling, quality inspection, maintenance decisions, HR selection. What starts today as a “practical AI feature” can quickly slip into the high-risk category – with corresponding obligations.

Why ERP becomes the backbone of AI compliance

In many mid-market companies the ERP system is already the central place for master and transaction data: articles, bills of material, customers, suppliers, prices, orders, stock, production data. This is exactly where the lever lies to anchor AI compliance not as an isolated legal project, but as an integrated part of business steering.

The current generation of agentic AI systems is able to use information sources independently, perform actions and orchestrate complex task chains. For B2B trade and manufacturing this means concretely:

  • An AI agent checks material availability, suggests alternative suppliers and simulates the effects on margin and delivery date – directly in the ERP context.
  • A service agent automatically creates maintenance tickets, assigns them to the right assets, pre-plans resources and documents the history in the system.
